1. Introduction

Welcome to The Salty Tarot App (the “App”), operated by The Merc Centers LLC, doing business as “The Salty Tarot” (“we,” “us,” or “our”).
These Terms of Use (“Terms”) govern your access to and use of the App, our website, social media platforms, and any related digital experiences (collectively, the “Services”).

By downloading, accessing, or using the App, you agree to these Terms and our Privacy & Data Protection Policy. If you do not agree, discontinue use immediately.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to use this App. By using it, you confirm these conditions are met.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App and its content for personal, non-commercial, spiritual, or entertainment purposes.

All intellectual property including, but not limited to tarot/oracle content, spells, spell instructions, crystal descriptions, astrology data, AI outputs, images, all digital experiences and software remain exclusive property of The Merc Centers LLC DBA The Salty Tarot and its licensors.

4. User Accounts and Security

You may be required to create an account with a verified email, password, and date of birth.
You are responsible for maintaining confidentiality of your credentials and for all actions under your account.

5. Subscriptions, Purchases, and Billing

5.1 Overview

The App offers access to premium metaphysical content and features through auto-renewing subscriptions and digital purchases processed through the Apple App Store or Google Play Store.

5.2 Paid Services

Digital services may include, but are not limited to:

• Monthly or Annual Subscriptions for premium access to tarot, oracle, astrology, spells, rituals, and crystal reading-based content.
• Tarot and Oracle Readings are delivered digitally within the App.
• Horoscopes and Planetary Energy Readings.
• Crystal Collections and Energy Tools.
• Digital Spells, Rituals, and  Affirmation Guides.
      Each metaphysical based digital service is for entertainment and educational use only.

5.3 Auto-Renewal and Cancellation

• Subscriptions renew automatically unless canceled at least 48 hours before renewal.
• Account billing occurs 24 hours before the renewal date.
• You can cancel or modify your subscription anytime via your Apple ID or Google Play settings.
• Deleting the App does not cancel your subscription.

5.4 Refunds

All purchases are final and non-refundable except where required by law or by platform policy.

5.5 Price Changes

We may modify pricing or tiers. Changes will take effect after reasonable notice or upon your next billing cycle.

6. Digital Goods, Spells, and Spiritual Based Content

All materials, readings, spells, rituals, affirmations, astrology data, crystal collections, etc. made available through The Salty Tarot App are digital experiences and intellectual property of The Merc Centers LLC, DBA The Salty Tarot.

You receive a personal, non-transferable, limited-use license to access this content for self-reflection, entertainment, and spiritual exploration.

None of the content, contained within the confines of the app or affiliated sites including but not limited to downloads Tarot/Oracle readings, Crystals, Horoscopes, spells, rituals, spell guides, energy readings, grant you ownership, resale rights, or commercial license.
All artwork, text, spell names, voiceovers, written readings, and digital experiences remain the sole property of The Merc Centers LLC.

Any redistribution, reproduction, or commercial use of content from the App without prior written consent is strictly prohibited and may result in termination of your license and legal action.

7. Community Behavior and Responsible Use

The Salty Tarot community (including in-app discussions, Discord, or affiliated platforms) is intended to be uplifting, humorous, self-reflecting, and inclusive.
You agree to conduct yourself respectfully and refrain from:

• Sharing personal or identifying information about others.
• Engaging in hate speech, harassment, bullying, or slander.
• Posting content that violates any copyright, privacy, or intellectual property laws.
• Impersonating any individual or entity, including The Salty Tarot team.
• Attempting to hack, scrape, or disrupt any aspect of the Services.

Violation of community standards or digital misconduct may result in immediate suspension or permanent removal without refund.

8. Disclaimer — Spiritual Opinion, Expression, and Entertainment

All readings, spells, rituals, horoscopes, planetary forecasts, related materials and digital experiences provided through The Salty Tarot App represent spiritual opinion and metaphysical belief, not scientific or empirical fact.

The App provides entertainment, spiritual, metaphysical, and reflective guidance only.
You understand and agree that:

• Results, manifestations, or energetic outcomes are not guaranteed.
• Any digital suggestions, rituals, or spells are offered as symbolic acts of intention—not literal instructions for measurable change.
• Individual experiences will vary according to personal belief, intention, self-discipline and interpretation.

We do not claim that any spiritual, energetic, or astrological content can alter reality, health, finances, relationships, or fate.

Use discretion, humor, and self-responsibility when engaging with any reading or spell.

9. Physical Safety & Fire Liability Disclaimer

Some rituals and spells may include suggestions for the use of candles, herbs, crystals, incense, oils, or other tangible tools.
You agree to exercise reasonable caution and safety when using these materials.

By using this App, you expressly acknowledge and agree that:

• You are solely responsible for your safety, property, and physical environment.
• You will not leave flames, heat sources, or burning objects unattended.
• You will ensure any ritual, spell, or activity is performed in a safe and lawful manner.
• The Merc Centers LLC DBA The Salty Tarot assumes no liability for injury, property loss, or damage caused by unsafe handling or misuse of candles, oils, herbs, or any suggested materials.

If you are uncertain how to safely perform a ritual or handle any material under digital direction of this app, do not proceed.

10. AI-Generated Content and Human Oversight

Certain readings, horoscopes, or insights within The Salty Tarot App may be created, enhanced, or curated using artificial intelligence (AI)under direct human supervision.

AI-generated content is:

• Intended for metaphysical and spiritual entertainment and self-discovery only.
• Not predictive, diagnostic, or factual.
• Subject to review by authorized team members to maintain alignment with the App’s ethical and brand standards.

By using AI-enhanced features, you consent to automated processing of non-sensitive data (e.g., date of birth, zodiac sign, usage patterns. Etc.) as described in our Privacy Policy.

11. Limitation of Liability

To the maximum extent allowed by law, The Merc Centers LLC DBA The Salty Tarot, its owners, employees, affiliates, and licensors shall not be liable for any:

• Indirect, incidental, consequential, special, exemplary, or punitive damages.
• Loss of profits, reputation, or spiritual expectation.
• Injury, fire, property damage, or harm (bodily or property) resulting from user actions or interpretations.

Our total aggregate liability, if any, shall not exceed the total amount paid by you for the App in the 12 months preceding the claim.

12. No Medical, Financial, or Legal Advice

You acknowledge that The Salty Tarot App and its creators are not licensed medical, financial, or legal professionals.

Nothing within the App should be used to:

• Diagnose or treat medical conditions.
• Replace therapy or counseling.
• Make legal, business, or financial decisions.

Always seek appropriate professional advice before acting on any information obtained through the App.

13. Warranty Disclaimer

The App, Services, and all content are provided “as is” and “as available.”
We make no warranties, representations, or guarantees—express or implied—regarding the accuracy, reliability, or completeness of any content or results.

Use of the App is at your own discretion and risk.

14. Termination

You may terminate your account at any time using the in-app Delete My Account function or by contacting helpdesk@thesaltytarot.net

We reserve the right to suspend or terminate your account without refund for:

• Violations of these Terms or  community guidelines.
• Fraudulent activity.
• Abusive or illegal conduct.

Upon termination, your license to access all premium and free digital content will be revoked immediately.

15. Intellectual Property Rights

All text; artwork, voice content, spell titles, designs, icons, logos, graphics, software architecture, etc. are the exclusive property of The Merc Centers LLC DBA The Salty Tarot.

You may not copy, modify, translate, or create derivative works without written permission.
Unauthorized reproduction or misuse may result in civil or criminal penalties.

16. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA.

Any dispute, controversy, or claim shall be resolved by binding arbitration in Volusia County, Florida, administered by the American Arbitration Association (AAA) under its commercial rules.

You agree to resolve disputes individually and waive any right to participate in a class action or jury trial.

17. Indemnification

You agree to indemnify and hold harmless The Merc Centers LLC DBA The Salty Tarot, its affiliates, directors, officers, and employees from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App.
• Your violation of these Terms.
• Any physical injury, property damage, or loss resulting from the use of candles, herbs, oils, crystals, or any other items referenced in our content.

18. Updates to These Terms

We may modify these Terms periodically to reflect updates in laws, technology, or our Services.
We will post the updated version within the App and on our website, along with a revised “Last Updated” date.
Continued use after such updates constitutes acceptance of the new Terms.
